Article 1 – Definitions
For the purposes of these General Terms and Conditions, the following definitions apply:
Withdrawal period:
The period during which the consumer may make use of the statutory right to withdraw from the agreement.
Consumer:
A natural person acting for purposes outside any trade, business, or professional activity who enters into a distance agreement with the entrepreneur.
Day:
A calendar day.
Recurring agreement:
A distance agreement concerning multiple products and/or services for which delivery or purchase obligations take place over a period of time.
Durable medium:
Any medium that allows information addressed personally to the consumer or the entrepreneur to be stored in a way that enables later consultation and unchanged reproduction.
Right of withdrawal:
The legal right of the consumer to terminate the distance agreement within the withdrawal period.
Entrepreneur:
The natural person or legal entity offering products and/or services to consumers via distance selling.
Distance agreement:
An agreement concluded within an organized system for distance sales, whereby only remote communication methods are used up to and including the conclusion of the agreement.
Means of distance communication:
Any method that enables a contract to be concluded without the physical presence of both parties at the same location.

Article 3 – Applicability
These General Terms and Conditions apply to all offers made by the entrepreneur and to all distance agreements and orders concluded between the entrepreneur and the consumer.
Before the distance agreement is concluded, the consumer will be given the opportunity to review these General Terms and Conditions. If this is not reasonably possible, the entrepreneur will indicate how the terms can be accessed electronically and will provide them free of charge upon request.
If additional conditions apply to specific products or services, the provision most favorable to the consumer shall prevail in the event of conflicting terms.
If any provision of these General Terms and Conditions is deemed invalid or unenforceable, the remaining provisions shall remain fully effective. The invalid provision shall be replaced by a clause that most closely reflects the original intent.
Article 4 – Offers
Offers that are subject to a limited duration or specific conditions will be clearly indicated.
All offers are non-binding. Ashley & Joshua reserves the right to amend, suspend, or withdraw any offer at its discretion.
Each offer contains a clear description of the products and/or services offered. Product images are intended to represent the items accurately; however, minor variations in color or appearance may occur.
Each offer specifies:

How the agreement is concluded

Whether the right of withdrawal applies

Article 5 – Formation of the Agreement
The agreement is concluded once the consumer accepts the offer and complies with the stated conditions.
If acceptance is confirmed electronically, the consumer may withdraw from the agreement until such confirmation has been provided.
Article 6 – Right of Withdrawal
Consumers may return non-discounted products within 30 days of receipt without stating a reason, provided the items are unused, in original condition, and returned in their original packaging.
Products purchased as part of a Final Sale, defined as items discounted by 40% or more, are excluded from returns, refunds, and exchanges. This exclusion is clearly communicated at the time of purchase.
Article 7 – Costs Related to Withdrawal
If the right of withdrawal is exercised, the consumer is responsible for all return shipping costs. Returns are sent directly to Ashley & Joshua’s overseas supplier in China.
Refunds, including standard outbound shipping costs, will be processed within 14 days after receipt of the returned item or valid proof of return shipment.
Article 8 – Exclusions from Withdrawal
The right of withdrawal does not apply to:

Products excluded for hygiene reasons, such as earrings or lingerie

Items purchased during Final Sale promotions (40% discount or higher)
Article 9 – Pricing
Prices stated in an offer will remain valid during the specified offer period, unless adjustments are required by law or regulation.
Article 10 – Product Conformity and Warranty
Ashley & Joshua guarantees that products and services comply with the agreement and meet reasonable standards of quality, usability, and reliability.
Article 11 – Delivery and Fulfillment
Orders are processed with due care.
If delivery is delayed, the consumer will be informed as soon as reasonably possible.
Article 12 – Payments
Unless expressly agreed otherwise, payment must be completed in full at the time of purchase.
All transactions made through Ashley & Joshua are governed by these Terms of Service, which define pricing, payment conditions, and delivery terms. Ashley & Joshua reserves the right to correct errors in pricing, product descriptions, or availability without prior notice.

Article 14 – Governing Law
Ashley & Joshua is operated by a company registered in the Netherlands. All agreements between the entrepreneur and the consumer are governed by Dutch law.
These Terms are subject to Dutch law unless mandatory consumer protection laws in the consumer’s country of residence provide otherwise. Statutory consumer rights remain unaffected.
Article 15 – Amendments
Ashley & Joshua reserves the right to amend these General Terms and Conditions. Any changes will be communicated at least 30 days before they take effect.
Article 16 – Shipping and Returns
Ashley & Joshua partners with third-party logistics providers located in China. Orders are therefore shipped from China.
Approved returns must also be sent to China. The applicable return address and instructions will be provided once the return request has been approved.

Article 17 – Legal Disclaimer
Return and exchange policies may be modified at any time without prior notice. Ashley & Joshua retains the final decision regarding the eligibility of any return or exchange request.
Nothing in these Terms limits or excludes rights granted under applicable consumer protection laws. Statutory rights remain fully intact and may vary depending on the consumer’s country of residence.
Winter Sale:
Our winter sale is valid until February 28, 2026. After this date, all sale conditions and availability may change or expire automatically.
